“Sometimes, small business owners tend to procrastinate their securing of permits from LGUs (local government units) for a few months as they test the waters and feel their market first via guerilla marketing, not to mention the myriad of other requirements that they have to prepare before becoming legit,” Villar said.

“What’s the use of securing a business permit when you will have to throw in the towel after six months because of bad business climate or a bad business call aggravated by high power costs and other utilities,” he asked.

Villar noted this was not the first time that the DTI has revised the guidelines for the Business Name Law since it was enacted in 1931.

He recalled that in 2010, the IRR was revised twice in February and then in April.

Villar expressed concern that the proposed new set of guidelines would mostly affect the SME sector, which he said is the backbone of the economy, representing 99 percent of all registered companies in the country.

Villar noted that small businesses, by practice, would work on their requirements such as securing a business permit only after they are certain that their business would have an actual chance of succeeding and this could take more than six months to determine.

TOTOO nga siguro kasi businessman yang si villar...

you can open a icafe and operate if for 6months to test if OK... then if HINDI pwede kang mag stop... so wala kang gastos sa business permits atbp...

ang problema nyan if nagopen ka a few month before the BIR will do TAX MAPPING...
pano if napasyalan ka ng BIR... ano sasabihin mo???

second half of the year po ang safe na gawin yan
then ang pagkuha ng DTI sa December and mayors permit sa January as new business
hindi batas yan...bawal yan pero ginagawa pa rin

hindi naman problema ang pagkuha ng mga legal documents to run business, ang problema kasi dyan... yung mga tao magtatayo ng negosyo at yung mga na nasa likod ng pag papatupad ng batas, like DTI, BIR, SEC, Mayor's Permit at baranggay...ilan sa mga factors kung bakit mahirap at nakakatamad kumuha ng permit ay:

- paiba iba ng hinihinging requirements

- kailangan magpadulas ka para mas mabilis gawin ang mga papeles mo

- hindi alam ng magtatayo ng negosyo ang mga uri ng pag nenegosyo. (sole proprietorship, partnership and corporation).

- imbes na padaliin ang prosesso ng mga permit, mismong mga ahensya ng gobyerno ay magkaka salungat sa kanilang policy, kaya pag nag bigay ka ng papeles sa kanila dapat handa kang mag adjust sa mga hinihingi nila...

- tusong negosyante na wala talagang balak kumuha ng permit (ask DV...)

- POLITIKONG SAWSAWERO...

- one sided treatment sa mga lower class vs. upper class...


another thing hindi ako sigurado kung tama ang sinabi ni Villar na dapat hindi muna kumuha ng permit for 6 months to "test the water" of their business, maari kang mag operate habang nilalakad mo yung mga papeles mo pero never kang mag ooperate nang wala kang inaasikasong permit, parang inamin nya na mismong sya ay pina- practice nya ang ganung sistema, papaano kung within 6 months ay nag prosper sya at para makaiwas sa pag gawa ng permit ang gagawin nya ang lilipat lang sya ng pwesto, so papaao mahahabol ng gobyerno yung tax na kinita ng negosyante???

tungkol naman sa pagka lugi, hindi mo naman papasukin ang isang negosyo kung nag aalangan ka di ba? kaya nga tayo gumawa ng "Feasibility Studies" para ma foresee na natin ang magiging scenario at para makagawa na tayo ng plan A to plan Z...na kasawiang palad ay hindi ginagawa ng iba nating kapwa Pilipino in other words "Bara-Bara, Bahala na at Pwede na yan" System...

Sa mga micro business, kung natyempuhan ka ng BIR sa tax mapping, sabihin mo bago ka lang negosyante, hindi pa registered. Pwede mo naman iparegister kung tingin mo ay kikita na talaga yung business. Kung tingin mo na di tatagal, eh di isara mo na. Wala namang record ang BIR sa business mo, pano ka nila hahanapin? Sunod na punta nila, sarado ka na.

Ang mahirap yung pinaregister mo agad sa BIR, tapos pagkatapos ng 6 na buwan, hindi pala kikita. Pag ganyan, may kailngan ka nang ipasang mga monthly forms. Pag hindi ka nag-comply, ang lalaki ng penalty, pwede ka pa makulong. Ang hirap atang magsara ng business sa BIR, may audit pa, kaialangan kumpleto books of accounts mo, hindi biro.

kaya nga po master, bago sana sila magtayo... try to create "Feasibility Study" muna... ang nangyayari kasi kapag nakita ng tao ang negosyo na malakas hindi na pag aaralan eh! gagayahin na lang, kaya kapag nalugi isisisi sa gobyerno ang kapalpakan nila...
