para sa non-vat ang quarterly percentage tax ay form 2551Q ang quaterly income tax ay 1701Q, so ang 2551Q hanggang 4th Quarter pa rin pina file yan afik, pero kung sabi nyo nga tinanggal na nila, d mas mabuti. Yes, I checked with the BIR website and found that percentage (non-VAT) taxpayers will have to pay this tax every month using BIR Form 2551M. Deadline for filing is every 20th of the following month.

Ang BIR Form 2551Q ay hindi para sa mga taxpayers na tulad ng lanshop owners. Ito ay for the following:

1. Franchise grantees sending overseas dispatch, messages or conversation from the Philippines;and

2. Proprietor, lessees or operators of cockpits, cabarets, night or day clubs, boxing exhibitions, professional basketball games, jai-alai and racetracks.

Yes, ang deadline sa pag-file ng 2009 BIR registration at pagpapatatak ng books para sa next year ay next week na unless BIR will say that their office will be open during the holidays.

There is no reason why your books of accounts will remain unused unless you did not operate your business for the whole year of 2008 which BIR will know based on the Form 2551M that you filed with them. Normally, laging bago ang tinatatakan na books unless, say, you registered and begun operating on the 4th quarter of the year.

I intentionally picked this post to explain that to comply with the Income Tax requirement listed in your COR, you have to file and pay the appropriate income tax for the first three (3) quarters of the year using BIR Form 1701Q and your Annual Income Tax Return using BIR Form 1701 on or before April 15th of the succeeding year.

Any failure to file 1701Q will result to an "open case" against the taxpayer. "Open cases" are normally known by the taxpayer when he renew his BIR registration at this time of the year. An "open case" carries a P1000.00 penalty.

Waaaaaa Tama po si Sir Xico....

Nagkaroon nga ako ng "Open case" dahil 2nd & 3rd Quarter ng Tax return ang di ko na file.... Pero swerte pa rin me ibinigay sa aking parang clearance ung isang Magandang empleyada sa DPS(Di ko na idetalye meaning ng DPS for security purposes... PM na lang po ako for clarifications) kya di na ko nagpenalty, dalhin ko lang daw lagi ung pagmagrerenw ako... Kagagaling ko lang ng BIR kanina, masalimuot talaga to pag di mo iintindihin pero once na maintindihan mo, madali lang pala kase ngaun ko lang nalaman na wala naman palang dapat bayaran pag magpatatak ka ng bagong book of acct, kse last year nadale pa ko nun tagalakad ko, kinuhaan ako ng 500 petot kla ko para sa payment form na un (0605) un pala malaman kickback nya lang un... Nways dito sa amin madali naman kausap mga taga BIR very accommodating naman sila, basta wag lang din arugante dating mo they are much willing to help...

mga sir malaki laki problema ko aheheh ang tagal ko na nag ooperate wala pa ako inilalagay sa 3 books na binigay sa kin ,pero nagbabayad ako ng 2551m at 1601e evry month at nagreresibo rin ako sa mag customer,till now hinde ko alam kung ano inilalagay sa tatlong books na yun saan ba ako pwede magpaturo ahehehhehe

Simplified Net Income Tax Scheme (SNITS)

THE House of Representatives late Tuesday passed legislation on the Simplified Net Income Tax Scheme (SNITS) for individuals engaged in trade and business and or practice of profession.

House Bill 5521 seeks to amend the National Internal Revenue Code of 1997, as amended. The measure seeks to limit the expenses that may be deducted from gross revenues earned by professionals and individuals running their own businesses to arrive at their taxable income.

The self-employed can afford to pay less by declaring various expenses as “costs of operating the business” and deducting these from their taxable income. The bill said that in computing taxable income subject to tax in the case of self-employed individuals or professionals, only the following deductions subject to substantiation shall be allowed:

1) A reasonable allowance for salaries and other compensations;

2) A reasonable allowance for supplies and utilities incurred, in the pursuit of the taxpayer’s trade or business, profession or occupation;

3) A reasonable allowance for rentals and or payments which are required as condition for the continued use or possession of property to which the taxpayer has not taken or is not taking title or in which he has no equity other than that of a lessee, user or possessor, in the pursuit of the taxpayer’s trade or business, profession or occupation;

4) Interest paid or accrued within a taxable year on loans contracted from accredited financial institutions which must be proven to have been incurred in the pursuit of the taxpayers’ trade or business, profession or occupation.

5) Taxes paid or incurred within the taxable year in the pursuit of the taxpayer’s trade or business, profession or occupation except the income tax provided for under the following: income taxes imposed by authority or any foreign country, estate and donor’s taxes and taxes on real property not used in the taxpayer’s trade or business, profession or occupation;

6) A reasonable allowance for depreciation, for the exhaustion, wear and tear of property used in the pursuit of the taxpayer’s trade or business, profession or occupation;

7) A reasonable allowance for research and development not in excess of 5 percent of gross income in the pursuit of the taxpayer’s trade or business, profession or occupation;

8) Contribution made to the government and accredited relief organizations for the rehabilitation of calamity-stricken areas declared by the President.

The measure, authored by House Majority Leader Arthur Defensor and Antique Rep. Exequiel Javier, also offers a 40-percent optional standard deduction for them in lieu of deducting expenses that are usually hard to compute.

Professionals and self-employed individuals will be required to register with four state agencies under the House bill that seeks to ensure they pay the correct taxes. Under House Bill (HB) 5521, which substituted HB 5257, professionals and self-employed individuals will have to register with the Social Security System, Philippine Regulatory Commission (PRC), Department of Trade and Industry, and the Board of Investments.

Bilang lehitimong negosyante kelangan talagang bigyan natin ng pansin itong usaping ito, kase in the end kung iignore natin ang mga ito, tayo rin ang talo e, liit na nga kita natin tapos sa penalty lang mapupunta kitain natin, sayang naman...

Basta kung hindi nyo maiintindihan magtanong... kung tinatamad de magtiis magbayad kung me pambayad rin naman e, sa tulad ko ng konti lang ang units, titiyagain ko na lang muna na intindihin ung mga forms na dapat ifile, tulad ng Quarterly Income tax Return (1701Q) at Annual Income Tax Return (1701) mejo nakakalito sila compare sa Monthly Percentage Tax Return (2551M), kaya sa mga taong me oras para pag aksayahan ng oras at panahon ang mga ito e pagtitiyagaan na lang, tutal e wala namang bayad magtanong sa mga empleyado ng BIR e...

Madali lang yung Monthly Percentage Tax, at yung tax sa rent.

Nakakabadtrip lang sa rent di naman ikaw yung kumikita kung hindi yung may ari ikaw pa mag shoushoulder nun.Kasi 2005 ako nag operate ng business ngayon lang nga ako nakapagregister ang swerter ko naman di ako na tax mapped.Kaso pinadalhan ako ng sulat ng BIR na mag register daw ako kasi nakikita yung pag nag apply ka ng Business Permit sa Local.

Medyo nakakalito lang yung ilalagay sa Journal at Ledger, at yung 1701Q at Annual 1701 yun wala pa ako ng knowledge.
